Dayton to honor Martin Luther King, Jr. with march, rally and
address by Tuskegee Mayor Johnny Ford


A march, a rally and an address by Tuskegee, Alabama, Mayor Johnny Ford, a former state lawmaker and a founder of the National Conference of Black Mayors, will highlight Dayton’s annual Martin Luther King, Jr., celebration program in January.

King – a clergyman, activist and prominent leader of the Civil Rights Movement – received the Nobel Peace Prize for his efforts to end racial discrimination. This year’s theme for the Dayton celebration is “I’m Still Here.”

In addition to the march and rally, the celebration will feature a banquet, an interfaith prayer breakfast, a worship service, a school awards program and musical concert.

Ford was elected mayor of Tuskegee in 1972, becoming one of the first black mayors of a city of more than 10,000 people. He was elected as an Alabama state representative in 1998 and then re-elected mayor in 2004.

Ford is widely known for his involvement in the National Conference of Black Mayors and the World Conference of Mayors. He is a founder of both groups.
He was also appointed to the Presidential Advisory Committee on Federalism and the U.S. Intergovernmental Policy Advisory Committee on Trade.

At the MLK Celebration Banquet in Dayton, Ford plans to discuss black-on-black crime, unemployment, the digital divide and the need for affordable health care.

“The journey is not over,” said Ford. “Dr. King is still here. That means we much pick up the torch and continue the journey to the mountaintop of justice in this country.”

Ford received his bachelor degree in history and sociology from Knoxville College, his Master of Public Administration from Auburn University Montgomery and has received four honorary doctorate degrees.

Weingarten Rights Law & Legal Definition

The Weingarten right is a right is derived from the Supreme Court’s 1975 Weingarten decision where the court recognized union employees’ rights to representation at investigatory interviews. The National Labor Relations Board now takes the opposite position and holds that the right to representation at investigatory interviews applies equally to union and non-union employees.

Weingarten rights includes the right to have a coworker present at an investigatory interview that the employee reasonably believes might result in discipline. Weingarten rights must be invoked by an employee before an employer has any corresponding obligations. An employee must request the presence of a coworker at an investigatory interview.

The portion of the relevant federal statute provides that:

"(2) An exclusive representative of an appropriate unit in an agency shall be given the opportunity to be represented at -

  1. any formal discussion between one or more representatives of the agency and one or more employees in the unit or their representatives concerning any grievance or any personnel policy or practices or other general condition of employment; or
  2. any examination of an employee in the unit by a representative of the agency in connection with an investigation if -

                                i.            the employee reasonably believes that the examination may result in disciplinary action against the employee; and

                              ii.            the employee requests representation.


(3) Each agency shall annually inform its employees of their rights under paragraph (2)(B) of this subsection."

On June 15, 2004, The National Labor Relations Board ruled that nonunionized employees are not entitled under Section 7 of the National Labor Relations Act to have a coworker accompany them to an interview with their employer, even if the employee reasonably believes that the interview might result in discipline. This was a reversal of the July 2000 decision of the Clinton Board that extended Weingarten Rights to nonunion employees.
