In 2015, the state of Ohio purged hundreds of thousands of Ohioans from its voter rolls simply for failing to vote in recent elections.

Ohio's action—systematically preventing eligible Americans from exercising their right to vote—is illegal and undermines public confidence in the integrity of the electoral process. For that reason, Demos and the ACLU of Ohio filed a lawsuit in April against the Ohio Secretary of State to end the voter purges and restore the affected voters to the rolls.

Today, the U.S. Court of Appeals for the Sixth Circuit agreed that these purges were illegal and struck down Ohio's voter purge program, finding the practice violates the National Voter Registration Act of 1993 (NVRA). The case, which was brought on behalf of the Ohio A. Philip Randolph Institute, Northeast Ohio Coalition for the Homeless, and Ohio citizen Larry Harmon, now goes back to the district court to fashion a remedy for voters impacted by the purges.

The NVRA, passed in 1993 to increase participation in the electoral process, requires states to maintain accurate and up-to-date voter rolls. The law allows states to remove a voter's name from the rolls only if the voter has become ineligible, and it specifically prohibits states from removing voters for not voting.

Our client Larry Harmon was one of the voters purged in 2015, but, like many other Ohio voters, he did not learn he was off the rolls until he went to his polling place to vote last November. "I've been voting since 1976 and have lived in the same home for more than a decade, but when I went to vote, I was told that I wasn't registered," said Harmon explaining his experience during the November 2015 election. "It is my right to vote; staying home for a few years should not take that right away."

This decision joins a series of recent legal victories for groups challenging illegally burdensome voter suppression laws, including wins in North Carolina, Michigan, Kansas, Wisconsin, North Dakota and Texas.

What could this mean for you?


According to today's decision, states are prohibited from requiring voters to confirm their address or face being purged merely because they have not voted. Instead, states must obtain direct evidence that a voter has a new address, such a forwarding address on file with the Postal Service or a change of address submitted to a motor vehicle office.

If you reside in Ohio, you should check your registration status and if necessary, re-register before the registration deadline of October 11, 2016. If you miss the deadline, you may still cast a provisional ballot during the early voting period or on Election Day.

Donald Trump is lying to the American people about his plans for Social Security. In his campaign speeches, Trump claims that he won't make any changes to the system. But a mountain of evidence, including the Republican platform, makes it clear that a President Trump would be happy to sign Speaker Paul Ryan's Social Security cuts into law.

Unfortunately, Trump's Social Security lies have largely flown under the radar. Most voters don't know about his real stance. The Presidential debate next Monday is the perfect opportunity to change that.

Call on debate moderator Lester Holt to hold Donald Trump accountable for supporting cuts to Social Security.

In a book he wrote during a previous publicity stunt run for President, Trump offensively referred to Social Security as a "ponzi scheme," called for the retirement age to be raised to 70, and said that "privatization would be good for all of us."

These days, Trump no longer talks about cutting Social Security, at least when he's in front of voters. That's because he knows that 88% of voters, including 84% of Republicans, oppose benefit cuts.

But Trump's actions speak louder than his words. For his running mate, he chose Mike Pence -- who once criticized George W. Bush's plan to privatize Social Security for not going far enough! The Trump campaign had no objections to the GOP platform, which calls for cutting and privatizing Social Security.

It's time for the media to stop giving Trump a pass on Social Security. Join us in calling on Lester Holt to hold Trump accountable about his real plans to dismantle Social Security brick by brick.

Here are some common reason voters become ineligible:
   

  • If you have moved since the last time you voted
  • A name change has occurred
  • You switched political parties

  • Voting laws have changed since the last time you voted
