In 2015, the state of Ohio purged hundreds of thousands of Ohioans from its voter rolls simply for failing to vote in recent elections.

Ohio's action—systematically preventing eligible Americans from exercising their right to vote—is illegal and undermines public confidence in the integrity of the electoral process. For that reason, Demos and the ACLU of Ohio filed a lawsuit in April against the Ohio Secretary of State to end the voter purges and restore the affected voters to the rolls.

Today, the U.S. Court of Appeals for the Sixth Circuit agreed that these purges were illegal and struck down Ohio's voter purge program, finding the practice violates the National Voter Registration Act of 1993 (NVRA). The case, which was brought on behalf of the Ohio A. Philip Randolph Institute, Northeast Ohio Coalition for the Homeless, and Ohio citizen Larry Harmon, now goes back to the district court to fashion a remedy for voters impacted by the purges.

The NVRA, passed in 1993 to increase participation in the electoral process, requires states to maintain accurate and up-to-date voter rolls. The law allows states to remove a voter's name from the rolls only if the voter has become ineligible, and it specifically prohibits states from removing voters for not voting.

Our client Larry Harmon was one of the voters purged in 2015, but, like many other Ohio voters, he did not learn he was off the rolls until he went to his polling place to vote last November. "I've been voting since 1976 and have lived in the same home for more than a decade, but when I went to vote, I was told that I wasn't registered," said Harmon explaining his experience during the November 2015 election. "It is my right to vote; staying home for a few years should not take that right away."

This decision joins a series of recent legal victories for groups challenging illegally burdensome voter suppression laws, including wins in North Carolina, Michigan, Kansas, Wisconsin, North Dakota and Texas.

What could this mean for you?


According to today's decision, states are prohibited from requiring voters to confirm their address or face being purged merely because they have not voted. Instead, states must obtain direct evidence that a voter has a new address, such a forwarding address on file with the Postal Service or a change of address submitted to a motor vehicle office.

If you reside in Ohio, you should check your registration status and if necessary, re-register before the registration deadline of October 11, 2016. If you miss the deadline, you may still cast a provisional ballot during the early voting period or on Election Day.

I believe that despite this, we are able to face these challenges. We need to take on the huge opportunities facing our country, and it starts with doing everything we can take help Democrats take back Congress.

One of the biggest problems facing our country is the pervasive influence of big money in politics. That's why it is so important for smaller-dollar contributions like yours to help take back the House of Representatives and make sure that Nancy Pelosi is our next Speaker of the House.

As a result of the disastrous Supreme Court ruling on Citizens United, the billionaire class is spending huge amounts of money to buy candidates and elections. We are now witnessing the undermining of American democracy and the rapid movement toward oligarchy where a handful of very wealthy families and their Super PACs will control our government.

As a result of this, the Republican Party is prepared to reject science in order to gain campaign contributions from the Koch brothers, Big Energy companies and others who make billions on fossil fuels, further accelerating the effects of climate change. And if we do not act boldly on climate change, the planet we leave to our grandchildren may be uninhabitable.

The United States once led the world in terms of the percentage of our young people who had college degrees. Today, in a highly competitive global economy, we are now in 12th place. Hundreds of thousands of bright young people have given up on the dream of higher education, while millions of others leave school with oppressive debt.

As a result of Republican inaction on key issues to strengthen our country, our infrastructure -- roads, bridges, rail, airports, water systems, wastewater plants, levees, dams -- is crumbling, and Congress refuses to appropriate anywhere near the necessary funds to rebuild it. If we do not invest substantially in infrastructure, a bad situation will only become much worse.

But the problems continue that we need to all work to fix.

Despite substantial gains, we still have a long way to go to achieve equality for people of color. Instead of investing in opportunities, we are locking people up at an incredible rate. We now have the highest incarceration rate in the entire world with over 2 million in prison and millions more on probation or parole. We have a broken immigration system that divides families and keeps millions of hard-working people in the shadows.

Even with growing poverty among seniors, almost all Republicans, and some Democrats, want to cut Social Security and benefits for disabled veterans. They want more austerity for the elderly, the children, the sick and the poor, and more tax breaks for the rich.

The wars in Iraq and Afghanistan have cost us thousands of lives and trillions of dollars. The United States spends more on the military than the next nine biggest-spending countries combined. Today, there are massive cost over-runs with defense contractors and the Pentagon cannot even pass an independent audit.

We are at a moment of truth. We need to face up to the reality of where we are as a nation. That starts with helping Democrats make gains in the House of Representatives.

BREAKING: Alabama Chief Justice suspended for rest of term following SPLC ethics complaint


The Alabama Court of the Judiciary today suspended Alabama Chief Justice Roy Moore for the rest of his term in office.

The Court ruled that Moore violated the canons of judicial ethics by ordering Alabama's probate judges to defy a federal court injunction requiring them to issue marriage licenses to same-sex couples on a non-discriminatory basis. This is the second time in 13 years that Moore has been sanctioned as a result of ethics complaints filed by the Southern Poverty Law Center.

"The Court of the Judiciary has done the citizens of Alabama a great service by suspending Roy Moore from the bench," said SPLC President Richard Cohen.

"He disgraced his office and undermined the integrity of the judiciary by putting his personal religious beliefs above his sworn duty to uphold the U.S. Constitution.

"Moore was elected to be a judge, not a preacher. It's something that he never seemed to understand. The people of Alabama who cherish the rule of law are not going to miss the Ayatollah of Alabama."

FBI Director James Comey recently broke years of precedent by explaining publicly, in minute detail, why the FBI would not charge Sec. Hillary Clinton. Unfortunately for Director Comey and the Department of Justice, Sen. Elizabeth Warren was paying close attention.1

Now, Sen. Warren wants to know why the public has never been told why the Justice Department refused to prosecute the bankers who caused the 2008 financial crash – and we want to help her demand answers.

The Financial Crisis Inquiry Commission investigated every detail of the crash and made criminal referrals to the Justice Department. The commission found that 14 of the biggest financial institutions had potentially committed securities fraud in the run-up to the crash. The commission also named 9 top executives who should be personally investigated.2

The Justice Department made zero criminal indictments. Not a single firm or individual faced a trial. Only one individual had to pay a fine – a paltry $100,000 – and of the 14 institutions, only five ended up paying any fines, as a result of civil settlements.3

Comey explained his decision in Sec. Clinton's case by declaring "the American people deserve those details in a case of intense public interest." In a recent letter, Sen. Warren responded by demanding the "same level of transparency" around the Wall Street crash. She separately demanded that the inspector general of the Justice Department mount his own investigation.4

If FBI Director Comey is willing to spend hours publicly detailing the ins and outs of an investigation, surely we should start with the failure to prosecute the bankers who crashed the economy, cost countless Americans their jobs and homes, and stole millions of dollars out of Americans' pockets.

The 10-year statute of limitations on many of these crimes runs out in 2017. We are running out of time to demand accountability. Bringing people to trial would not guarantee a guilty verdict or jail time. It would not bring back the jobs and homes lost. But prosecutions would send a clear message to Wall Street and help prevent the next financial crash. As Financial Crisis Inquiry Commission Chair Phil Angelides put it: "If you can steal $1,000 and settle for $20 would you do it again? Probably."5

We can't let that happen. If the FBI and Justice Department are suddenly so willing to be transparent, they should start with telling us why they let Wall Street off the hook.

"The Dignity in Schools Campaign called for the removal of law enforcement from schoolsWednesday in a policy document that also calls for new forms of discipline and student supports, such as restorative justice programs.

The coalition is made up of "over 100 organizations in 27 states and the District of Columbia representing students, parents, advocates, and educators that promote alternatives to a culture of zero-tolerance, punishment, criminalization, and the dismantling of public schools."

Its position paper, "Counselors Not Cops: Ending the Regular Presence of Law Enforcement in Schools," comes a few weeks after federal officials released new resources, calling on schools to limit the roles of school-based officers and to ban their involvement in routine disciplinary issues that they said would be better addressed by school administrators. The federal guidance also called for better training and more carefully worded agreements between law enforcement agencies and schools.
But those recommendations didn't go far enough, the Dignity in Schools Campaign said, calling for the removal of designated, on-site officers altogether.

"The presence of police in schools has escalated dramatically in the last several decades, and the figures on arrests and referrals to law enforcement show disproportionate targeting of Black and Latino students and students with disabilities," the coalition said in a news release. "This is just one aspect of the school-to-prison pipeline, where some students are denied an opportunity to succeed, and instead are pushed out of school and into the juvenile or criminal justice system."
Black students were more than twice as likely to be referred to law enforcement or arrested at school than their white peers in 2013-14, according to the latest data from the Education Department's office for civil rights.

Civil rights advocates have said problems created by officers' implicit biases and poorly defined roles within a school are exacerbated by broad school disciplinary codes and state laws that ban acts like "defiant behavior," under which students are often inconsistently disciplined.

In addition to removing on-site officers, schools should carefully define the purpose of police that are called to the school to respond to calls, the Dignity in Schools Campaign said.

"On those rare occasions when it is appropriate for law enforcement to enter a school building, there should be agreements with police departments that limit the cases when law enforcement can be called in to a school, with particular safeguards in place to ensure students' rights are protected," the organization said.
The National Association of School Resource Officers, which trains and represents school-based police, largely agreed with the federal guidance.

"Like Education Secretary [John] King, we believe that administering formal school discipline belongs solely in the hands of educators, and that educators should be well trained to address behavioral issues through a variety of interventions that do not involve law enforcement officers," the organization said in a statement."
